Declaration of performance
Dear Ladies and Gentlemen,
We would like to remind you of the necessity to draw up (as of 01.07.2013), by the Owners of the certificates of constancy of performance, the declaration of performance for construction products falling within the scope of the certification. This obligation arises from Article 66 point 2 of the Regulations (EU) no 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (CPR).
Particular attention should be paid to the fact that the obligation in question applies equally to Owners of certificates of compliance issued pursuant to the Council Directive 89/106/EEC of 21 December 1988 on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products (CPD), as well as to Owners of certificates of constancy of performance issued based on the Regulations No. 305/2011.
Please keep in mind that for construction products manufactured since 01.07.2013, the document entitling the manufacturer to place the construction product on the market is not a declaration of conformity but the declaration of performance mentioned earlier*.
A template of the declaration of performance can be obtained from Commission Delegated Regulation (EU) No 574/2014 of 21 February 2014 amending Annex III to Regulation (EU) No 305/2011 of the European Parliament and of the Council on the model to be used for drawing up a declaration of performance on construction products.
CNBOP-PIB would also like to inform you that the said declaration, its content and correct drawing up is neither verified by CNBOP-PIB Certification Body during the process of assessment and verification of constancy of performance of construction product, nor during the inspection of Factory Production Control (carried out before granting certification and during supervising the granted certification) at the manufacturing plant specified by the manufacturer of the product.
*Please keep in mind that in Poland products used in fire protection are required to obtain a certificate of admittance (in addition to the declaration of performance) in accordance with the Act of 24 August 1991 on fire protection (Journal of Laws – Dz. U. 2009 No. 178, item 1380 with subsequent amendments).
